On October 13, 2022, Orihuela Court No. 3 issued sentence 238/202, by which it upheld the legal action for compensation of damages filed by Palomar Abogados in favor of a woman affected by bank phishing, and sentenced CAJA RURAL CENTRAL to compensate our client an amount of 4,985 euros as  well as the procedural costs of the claim.

In November 2021, a customer of CAJA RURAL CENTRAL was the target of a bank phishing. By virtue of it, a cybercriminal who had previously taken over the username and password credentials of the bank customer, impersonated her identity and carried out up to 11 unauthorized payment operations, causing the affected person a loss of 4985 euros.

The victim of CAJA RURAL CENTRAL went to Palomar Abogados, and we filed a lawsuit for compensation for damages for the amount stolen, alleging that our client had at no time incurred in serious negligence in the custody of her credentials.

In the course of the trial, our lawyer highlighted the reasons why the responsibility for this loss should fall exclusively on the bank, and in this way we obtained a successful sentence that, together with so many others that have been produced, set a precedent about the position of the Courts and Tribunals in this specific type of claim.
