On September 6, 2023, Valencia Court No. 20 issued sentence 246/2023, by virtue of which  it upheld the legal claim for compensation for damages filed by Palomar Abogados in favor of some affected by bank phishing, condemning UNICAJA BANCO, S.A. to compensate our customers an amount of 4,999 euros  as well as the legal interest and procedural costs of the claim.

In June 2022, some customers of Unicaja Banco, S.A. in Valencia received an SMS from a cybercriminal with a link, which directed them to a fake UNICAJA BANCO website; Upon entering the aforementioned website, customers, thinking in good faith that they were dealing with the bank, provided their personalized security credentials to the online banking platform. As a result, the cybercriminal made a fraudulent bank transfer in the amount of €4,999.

UNICAJA BANCO, S.A., notwithstanding the complaint expressed by its customers,. he ignored the event, avoiding any type of responsibility, which forced them to choose to put themselves in the hands of Palomar Abogados.

At Palomar Abogados we filed a lawsuit for compensation for damages for the amount stolen, alleging the absence of gross negligence on the part of those affected, and the lack of diligence on the part of UNICAJA BANCO in not activating the relevant anti-fraud protocol at the time the cybercriminal connected to the customers' online banking.

In short, we argued that UNICAJA BANCO, S.A.'s signature authentication system was deficient because it did not comply with the legal regulations on strong authentication of bank customers.
